By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.
2. Definitions
- “We”, “us”, “our” means Thiphroxslyxao.
- “You”, “your” means the visitor or customer.
- “Website” means thiphroxslyxao.world and its subpages.
- “Products” means the goods (including Digestavita and any other items) offered for sale on the website.
- “Order” means your offer to purchase products submitted via the website or other agreed channel.
3. Use of the website
You agree to use the website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You must not:
- Use the site in any way that breaches applicable laws or regulations.
- Transmit any harmful, offensive or illegal content or malware.
- Attempt to gain unauthorised access to our systems, other users’ accounts, or any data not intended for you.
- Use automated means (e.g. scraping, bots) without our prior consent.
- Impersonate any person or entity or misrepresent your affiliation.
We may suspend or terminate your access to the website if we reasonably believe you have breached these Terms.
4. Products and information
We sell food supplements and related products. Product descriptions, images and pricing are provided in good faith but may be subject to change. We do not guarantee that product descriptions or other content are error-free. We reserve the right to correct errors and to limit quantities. Digestavita and other products are food supplements and are not intended to diagnose, treat, cure or prevent any disease. You should read the product information and, if in doubt, consult a healthcare professional before use.
5. Orders and contract formation
When you submit an order, you are making an offer to buy the products on these Terms. A contract between you and us is formed only when we accept your order (e.g. by sending an order confirmation by email). We may refuse or cancel an order (e.g. if the product is unavailable, if we suspect fraud or an error, or for other legitimate reasons). If we cancel after you have paid, we will refund you in full.
You are responsible for ensuring that the details you provide (name, address, email, phone) are accurate and complete. We are not responsible for failed delivery or communication due to incorrect details.
6. Price, payment and delivery
Prices are displayed in GBP (or as stated on the site) and include VAT where applicable. Delivery charges (if any) will be shown before you confirm the order. We reserve the right to change prices; changes will not affect orders already accepted. Payment is due as specified at checkout. We use secure payment methods; card details are processed by our payment provider and we do not store full card numbers. Delivery times and methods are as stated on the website or in your order confirmation. Risk in the products passes to you on delivery. Title passes when we have received full payment.
7. Returns and refunds
Your right to cancel and return products is set out in our Return Policy. By placing an order you agree to that policy. In summary: you have a legal right to cancel most distance contracts within 14 days and receive a refund, subject to the conditions in the Return Policy.
8. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
Subject to that:
- We are not liable for any indirect, consequential or special loss, loss of profit, revenue, data or goodwill, or for business interruption.
- Our total liability to you in connection with any order or use of the website shall not exceed the amount you paid to us for the relevant products in the 12 months before the claim arose.
- We are not responsible for delays or failures caused by events outside our reasonable control (e.g. natural disasters, pandemics, strikes, failure of suppliers or carriers).
9. Intellectual property
All content on the website (text, images, logos, design, layout) is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may view and print pages for personal use only. You must not copy, modify, distribute or use our content for commercial purposes without our written permission.
10. Privacy and data
Your use of the website and any order are also governed by our Privacy Policy and Cookie Policy. By using the site and providing your data, you consent to the processing described there.
11. General
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction (unless you are a consumer resident in Scotland or Northern Ireland, in which case you may also bring proceedings there). If any part of these Terms is held to be invalid or unenforceable, the rest remains in force. Our failure to enforce any right does not waive that right. We may amend these Terms from time to time; the “Last updated” date will change. Continued use of the site or placing new orders after changes constitutes acceptance of the updated Terms. For existing orders, the Terms in force at the time of the order apply.
